ORDER


RE: Defendants' Motion for Partial Summary Judgment on Plaintiffs' Claims for Damages Based on the Present Value of Alleged Overcharges

The Court is issuing this Order without a Memorandum Opinion at this time, in order to give parties more time to adjust their trial preparation. The final Memorandum Opinion will be released in the near future.

Pending before the Court is Defendants' Motion for Partial Summary Judgment on Plaintiffs' Claims for Damages based on the Present Value of Alleged Overcharges. Defendants seek to dismiss Plaintiffs' claims for a present value adjustment on their claim of damages under the Clayton Act. Upon careful consideration of the Defendants' motions, Plaintiffs' opposition, Defendants replies, arguments made at hearing, and the entire record herein, it is hereby

ORDERED that Defendants' motion for partial summary judgment is GRANTED; it is further hereby

ORDERED that Plaintiffs' claims for a present value adjustment on their claim of damages under the Clayton Act are DISMISSED.

SO ORDERED.
