ORDER RE: Lonza Defendants' Request for an Adjournment


Pending before the Court is Lonza Defendants' Request for an Adjournment of Daubert Hearings scheduled for March 20, 2003. Upon consideration of Defendant's motion, Reilly Defendants' Joinder, and the Class Plaintiffs' Response, it is hereby

ORDERED that Defendant's motion is DENIED. The hearings on (1) Niacin Defendants' Motion to Preclude the Expert Testimony of Dr. Bernheim and Dr. Perloff as Related to Niacin, and (2) Defendants' [Lonza's] Motion In Limine to Exclude the Expert Reports and Testimony of Dr. Perloff shall proceed as Ordered unless parties agree to withdraw the Daubert motions with prejudice. It is further hereby

ORDERED that counsel shall under the time limits established in the Court's February 6, 2003 Order Re: February Status Conference/Pretrial Conference Hearings.

SO ORDERED.
