STIPULATION AND PROPOSED ORDER POSTPONING HEARING


Due to unexpected and unavoidable circumstances rendering plaintiffs' expert Dr. Douglas Bernheim unavailable to appear in Washington D.C. on Monday February 3, 2003, the undersigned hereby stipulate that oral argument and expert testimony concerning the Niacin Defendants' Motion To Preclude The Expert Testinony of Dr. Bernheim and Dr. Perloff Related To Niacin should be rescheduled to Wednesday, February 19, 2003 at 10 am.
