STIPULATION AND ORDER


WHEREAS, the undersigned parties have reached a settlement agreement in principal; and

WHEREAS, the undersigned parties have not yet had the opportunity to document their settlement agreement;

IT IS HEREBY STIPULATED AND AGREED that the Niacin Defendants shall have until Wednesday, December 18, 2002 to serve any Reply to Plaintiffs' Response to Niacin Defendants' Motion to Exclude Expert Report and Testimony of Lexecon Regarding Niacin.
