Pursuant to the stipulation signed October 7, 2004, it is hereby

ORDERED that all claims of Plaintiff Kellogg Company ("Kellogg") in the above-captioned action are dismissed with prejudice against Defendants DuCoa, L.P. and DCV, Inc. This Order is without prejudice to the Kellogg's claims against any other defendants or alleged co-conspirators in the above-captioned cases.
