ORDER DISMISSING DEFENDANTS AVENTIS ANIMAL NUTRITION S.A, AVENTIS S.A., AVENTIS ANIMAL NUTRITION INC., AVENTIS CROPSCIENCE USA INC.

This matter being presented to the Court in connection with the unopposed Motion of Plaintiff McShares, Inc. to Dismiss Defendants Aventis Animal Nutrition S.A., Aventis S.A., Aventis Animal Nutrition Inc., and Aventis CropScience USA Inc. with prejudice,

IT IS HEREBY ORDERED that the First Amended Complaint in this action is dismissed with prejudice solely against Aventis Animal Nutrition S.A. (f/k/a Rhone-Poulenc Animal Nutrition S.A.), Aventis S.A. (f/k/a Rhone-Poulenc S.A.), Aventis Animal Nutrition Inc. (f/k/a Rhone-Poulenc Animal Nutrition Inc), and Aventis CropScience USA Inc. (f/k/a Rhone-Poulenc Ag Company Inc., f/k/a Rhone-Poulenc Inc.). This Order is without prejudice to McShares, Inc.'s claims against any other Defendant or alleged co-conspirator in the above-captioned case.
