MEMORANDUM OPINION


Relator Roderick Vinson contends the trial judge abused his discretion in denying relator discovery regarding real party Progressive County Mutual Insurance Company's handling and investigation of relator's insurance claim on the basis that real party had anticipated litigation on April 25, 2004. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relator has not shown the trial judge clearly abused his discretion. See In re Prudential Ins. Co. of Am., 148 S.W.3d 124, 135-36 (Tex. 2004). Accordingly, we DENY relator's petition for writ of mandamus.
