ORDER


Based on the Memorandum of Decision filed this date, the Court being fully advised and good and sufficient cause appearing;

IT IS HEREBY ORDERED that:

1. The Huntleys' motion for summary judgment on the state criminal restitution order is GRANTED, and Vessey's motion for summary judgment on the state criminal restitution order is DENIED. Such obligation is determined and declared to be nondischargeable pursuant to § 523(a)(7), The Huntleys shall lodge a proposed form of judgment.

2. Both parties' motions for summary judgment regarding the default civil judgment are denied. The Court will set a pre-trial status conference under Fed.R.Civ.P. 16 (Fed.R. Bankr, P. 7016) within sixty (60) days on the remaining issues.
