ORDER RE: FEES AND COSTS REQUESTED BY SCHUBERT REED AND KOHRMAN, JACKSON KRANTZ
The petition for award of attorneys fees from the common settlement fund filed by law firms Schubert Reed and Kohrman, Jackson Krantz is DENIED. The petition for reimbursement of costs by those firms is DENIED IN PART and GRANTED IN PART, as follows: Out of pocket costs of (1) the filing fee for the first complaint in this case, and (2) publishing a notice of it on Business Wire will be reimbursed from the common fund. No other costs shall be reimbursed.
The declaration submitted to the Court does not separately identify the costs outlined above. Accordingly, petitioning counsel are ordered to provide to the Court and to Co-Lead Counsel for the class a declaration setting out the filing fee and publication cost, on or before March 4, 2003. If Co-Lead Counsel challenges the accuracy of the stated costs, it may so notify the Court on or before March 14, 2003. Otherwise, unless the Court otherwise instructs Co-Lead Counsel prior to March 14, 2003, the petitioning firms shall be reimbursed for the stated costs from the common fund along with the other fee and cost disbursements authorized by this Court.
