Relator Villalobos & Vaughan, PLLC has filed a petition for writ of mandamus and a motion for stay pending the outcome of its petition for writ of mandamus. On December 8, 2015, real party in interest Raul Medina filed his first request for production, seeking attorney-client fee agreements and settlement documents from Villalobos that were listed as collateral on a promissory note that forms the basis of the underlying lawsuit. Villalobos filed a claim of privilege and objected to the requested discovery. On January 14, 2016, Medina filed a motion to compel that the trial court heard on January 21, 2016. The trial court issued its order on January 25, 2016, granting the motion and ordering Villalobos to remove its objections and produce all documents by January 29, 2016.
In its motion for expedited relief, Villalobos asks this Court to order all proceedings in the trial court stayed during the pendency of its mandamus. The Court, having examined and fully considered the motion for stay is of the opinion that the motion should be granted. The motion for stay is hereby GRANTED, and the trial court's order of January 25, 2016, and any proceedings associated therewith, are ordered STAYED pending further order of this Court, or until the case is finally decided. See TEX. R. APP. P. 52.10(b) ("Unless vacated or modified, an order granting temporary relief is effective until the case is finally decided.").
The Court requests that the real party in interest file a response to the petition for writ of mandamus on or before the expiration of ten days from the date of this order. See id. R. 52.2, 52.4, 52.8.
