ORDER SETTING EXPEDITED HEARING


Upon consideration of the motion by the debtors in possession for an expedited hearing on their motion for interim relief from collective bargaining agreements, it is

ORDERED:

1. The motion for an expedited hearing is granted, and a hearing on the motion for interim relief shall be held on Thursday, October 7, 2004, at 1:30 p.m.

There is already scheduled for hearing at that time another motion that the court anticipates may take some time to hear. The parties should therefore anticipate that the hearing on the motion for interim relief may not be concluded on October 7th. The date to which the hearing, if not concluded, is most likely to be continued, is October 12, 2004, at 9:30 a.m.

2. Responses opposing the motion must be filed with the court, and served on the debtors in possession and the United States Trustee, by 5:00 p.m. EDST on Tuesday, October 5, 2004. Any reply by the debtors in possession shall be filed with the court, and served on the responding parties and the United States Trustee, by 5:00 p.m. EDST on Wednesday, October 6, 2004.

3. Notice of the hearing shall be given by the debtors in possession not later than the business day following entry of this order — but in no event less than ten days prior to the hearing — to the respondent unions, the United States Trustee, the Official Committee of Unsecured Creditors, and to all parties who have filed requests for notices under Rule 2002(g).
