ORDER DENYING MOTION TO COMPEL


A hearing was held in open court on October 23, 2003, on the motion filed by Phillip H. Frazier to compel the reorganized debtors to respond to discovery requests, namely, the names of the hospital and doctor that allegedly performed knee surgery on Mr. Frazier and the date the procedure was performed (Docket # 4169). At the hearing, counsel for the reorganized debtors stipulated on the record that Mr. Frazier did not have knee surgery. It is, therefore,

ORDERED:

1.The motion to compel is denied as moot.

2.The clerk shall mail a copy of this order, or send electronic notice of its entry, to the parties listed below.
