IN RE UPDATES TO CJA COUNSEL INTERIM VOUCHER SUBMISSION AND SERVICE PROVIDER FEES

Criminal defendants in this district can be represented by Criminal Justice Act ("CJA") Panel Attorneys. CJA Panel Attorneys are ordinarily permitted to submit claims for compensation only after the final disposition of a case, unless good cause is shown.
Effective the date of this order, the court authorizes CJA Panel Attorneys to submit interim eVouchers provided such eVouchers exceed $1,000.00 and are submitted no more than once a month for each criminal case they are appointed for. The court reminds CJA Panel Attorneys that as soon as their total attorney fees and expenses are anticipated to exceed the statutory maximum, that they must complete and attach to their eVoucher the Request for Excess Compensation Form.
This order removes the withholding provisions of any existing interim payment orders, and CJA Panel Attorneys with existing withholding claims for fees and expenses may submit interim eVouchers to receive compensation for those services.
This General Order is consistent with the recommendation of the Judicial Council of the Ninth Circuit Court of Appeals contained in the Criminal Justice Act Policies and Procedures, adopted on October 20, 2016 and revised on April 20, 2022.
