Original Proceeding

ORDER

David Wayne Underwood's Petition for Writ of Mandamus was filed on August 23, 2017. The Court requests a response from the other parties to the proceeding. See TEX. R. APP. P. 52.8(b). Any response shall be filed with the Clerk of this Court no later than 28 days from the date of this order.

The Court notes that Underwood did not serve his petition on the respondent, which is the trial court judge, or the real party in interest, which is the State of Texas, as required by the Rules of Appellate Procedure. See TEX. R. APP. P. 9.5; 52.2. However, in this instance only, we use Rule 2 to dispense with this requirement and enclose a copy of the petition with this Order. Future requests for relief from Underwood which are not properly served will be denied.
