STIPULATION RE EXTENSION OF TIME FOR U.S. TRUSTEE TO FILE MOTION TO DISMISS FOR ABUSE
On February 10, 2011, the United States Trustee for Region 4 ("United States Trustee") filed his Statement of Presumed Abuse pursuant to 11 U.S.C. § 704(b)(1)(A) (Dkt. 24). As required by 11 U.S.C. § 704(b)(2), the United States Trustee must file his motion to dismiss for abuse not later than March 14, 2011. On February 25, 2011, the Debtors filed their Motion to Dismiss ("Motion") this case (Dkt. 29). Objections to the Motion are due on March 22, 2011; and, if objections are filed, a hearing will be held on March 29, 2011 (Dkt. 32). To conserve private and judicial resources, the Debtors and the United States Trustee, through their undersigned counsel as evidenced by the electronic signatures below, have agreed to extend the time upon which the United States Trustee can file his Motion to Dismiss (if necessary) until after any hearing on the Debtors' Motion.
Accordingly, the Debtors and the United States Trustee hereby stipulate and agree that the United States Trustee may have up to and including Friday, April 8, 2011, to file a Motion to Dismiss for Abuse.
WHEREFORE, the parties request that this Court approve this agreement and enter it as a Consent Order.
