Appointed counsel Frank Adler filed an Anders brief in this termination of parental rights appeal. Because appellate counsel was also trial counsel, he may not file an Anders brief. See Chandler v. State, 988 S.W.2d 827, 828 (Tex. App- Dallas, 1999, no pet.) Therefore, we STRIKE the January 24, 2022 Anders brief filed by Mr. Adler, Father's counsel.
We ORDER appointed counsel Frank Adler REMOVED from this appeal. We ORDER the trial court to appoint new counsel for Father and to inform the Court of the name of counsel within TEN DAYS of the date of this order.
We DIRECT the Clerk of the Court to send copies of this order to the Honorable Cheryl C. Lee-Shannon, Presiding Judge of the 305th Judicial District Court, to Frank Adler, and to Father at the address on file with the Court.
We ABATE this appeal for the appointment of new counsel for Father. The appeal will be reinstated upon receipt of the appointment of counsel or when the Court deems it appropriate to do so.
