ORDER DENYING MOTION TO WITHDRAW REFERENCE


This bankruptcy proceeding is before the court on Motion to Withdraw Reference submitted by defendants (who are also third-party plaintiffs). Although defendants articulate various reasons for their motion, they offer no legal or factual basis for finding in their favor. On the other hand, plaintiff D. Ray Strong has persuasively articulated why his claims are core case raises core issues and why defendants have waived any right to a jury trial.

Accordingly, defendants' Motion to Withdraw Reference (2-1) is DENIED.

SO ORDERED.
