ORDER
The clerk's record was due December 27, 2018, but was not filed. On January 17, 2019, the district clerk filed a notification of late record, indicating she calculated her due date incorrectly. In her notification, the district clerk requests additional time to complete the record and states she anticipates the record to be completed by February 15, 2019.
Rule 35.3 of the Texas Rules of Appellate Procedure provides that we may extend the deadline to file the record if requested by the district clerk; however, "[e]ach extension must not exceed 30 days" in an ordinary appeal. TEX. R. APP. P. 35.3(c).
Accordingly, we GRANT IN PART AND DENY IN PART the district clerk's request for an extension of time to file the clerk's record and ORDER the district clerk to file the clerk's record in this court on or before January 28, 2019.
We order the clerk of this court to serve a copy of this order on all counsel, the district clerk, and the trial court.
