The OAE correctly noted that reprimands may result if an attorney fails to cooperate with an arm of the disciplinary system, such as the OAE, which uncovers recordkeeping improprieties in a trust account and requests additional documentation. See In the Matter of Irving Tobin, DRB 20-213 (April 28, 2021) at 18.
We acknowledged that admonitions typically are imposed for violations of RPC 1.15(d) and RPC 8.1(b), but that reprimands may result where the attorney, like Tobin, failed to cooperate with the OAE's underlying audit concerning the identified recordkeeping deficiencies in a trust account. In the Matter of Irving Tobin, DRB 20-213 (April 28, 2021) at 17-19. We, thus, determined that a reprimand was the baseline discipline for Tobin's combined violations of RPC 1.15(d) and RPC 8.1(b).
