ORIGINAL PROCEEDING WRIT OF MANDAMUS

ORDER

Relators T.M. and M.D.M. each filed a petition for writ of mandamus in this court, on October 16, 2020, and on October 19, 2020, respectively. T.M. and M.D.M. ask this court to compel the Honorable John Millard, Associate Judge of the 328th District Court in Fort Bend County, to vacate his July 30, 2020 temporary orders following an adversary hearing.

T.M. filed a copy of the mandamus record. T.M. and M.D.M. filed a joint motion to seal the mandamus record, which includes the reporter's record of the adversary hearing, the exhibits from the hearing, and the clerk's record. The Texas Rules of Appellate Procedure do not provide for the appellate court to seal court records. We deny the joint motion to seal the mandamus record.

The mandamus record discloses the name of the child at issue in the underlying termination proceedings and the full names of relators and other family members, from which the identity of the child may be determined. See Tex. R. App. P. 9.8(b)(1)(A), (B). The mandamus record also discloses sensitive information, including the child's date of birth. See Tex. R. App. 9.9(a)(3), (b), (c).

We ORDER T.M. to file a redacted copy of the mandamus record in compliance with Rules 9.8(b)(1) and 9.9 by 5:00 p.m. on October 27, 2020. Failure to comply with this order shall result in the denial of T.M.'s and M.D.M.'s respective petitions for writ of mandamus.

We also request real party in interest Department of Family and Protective Services to file a response to the petitions on or before November 12, 2020.
