In re TIMOTHY L., a Person Coming Under the Juvenile Court Law. THE PEOPLE, Plaintiff and Respondent, v. TIMOTHY L., Defendant and Appellant.


Timothy L. appeals from his adjudication as a continued ward of the court and his placement at the California Youth Authority (CYA). Appellants court-appointed counsel has briefed no issues and asks this court to review the record pursuant to People v. Wende (1979) 25 Cal.3d 436.

In May 1998, the court adjudicated appellant a ward of the court pursuant to Welfare and Institutions Code section 602 after appellant admitted orally copulating a minor under the age of 18 (Pen. Code, § 288a, subd. (b)(1)). The court placed appellant at Unicorn Youth Ranch.

In December 2002, the probation department filed a supplemental petition (§ 777) alleging that appellant violated the courts previous orders by being alone with a child under the age of 14 and testing positive for THC.

Appellant admitted the allegations as alleged.

The court continued appellant as a ward of the court (§ 602) and committed him to CYA for a maximum period of three years. The court granted appellant 197 days total credit toward his maximum period of confinement.

Before appellant admitted the petitions allegations, the court advised him of the constitutional rights he would be waiving and the direct consequences of his admission. Appellant waived the enumerated rights and knowingly and voluntarily entered his admission.

Appellant was represented by counsel throughout the proceedings.

There was no error in the disposition.

There are no legal issues that require further briefing.

The order adjudicating appellant a ward of the court and placing him in CYA is affirmed.
