IN RE THE TEXAS DEPARTMENT OF FAMILY AND PROTECTIVE SERVICES
This proceeding arises out of Cause No. 2020-PA-01945, styled In the Interest of J.D., a Child, in the 150th Judicial District Court, Bexar County, Texas, the Honorable Mary Lou Alvarez presiding.
Sitting: Patricia O. Alvarez, Justice, Irene Rios, Justice, Lori I. Valenzuela, Justice.
ORDER
PER CURIAM.
On May 9, 2024, relator ("the Department") filed a motion to clarify this court's April 11, 2024 order, which stayed all proceedings in the underlying matter, trial court cause number 2020-PA-01945, and this court's May 6, 2024 order, which partially lifts that stay for the purpose of allowing the trial court to hold a permanency hearing. The Department's motion to clarify is GRANTED IN PART and DENIED IN PART.
We clarify that our April 11, 2024 order stayed all orders being reviewed in this court and stayed any further proceedings in trial court cause number 2020-PA-01945 on or after April 11, 2024. All unchallenged orders preceding our April 11, 2024 stay shall remain in effect, and previously challenged orders that we have already held are valid shall also remain in effect.
After reviewing the Department's motion and the attached trial court's notice of permanency hearing, we deny the Department's request to clarify scope, limits, and duration of the permanency hearing. The trial court's hearing notice is within the parameters of our May 6, 2024 order. Therefore, there is no need to clarify that order.
It is so ORDERED.
