ORIGINAL PROCEEDING WRIT OF MANDAMUS 129th District Court Harris County, Texas Trial Court Cause No. 2017-72382
Panel Consists of Chief Justice Christopher and Justices Jewell and Zimmerer.
MAJORITY ORDER
PER CURIAM
On Tuesday, January 30, 2024, relators The Cordish Company and Bayou Place Limited Partnership filed a petition for writ of mandamus in this Court. See Tex. Gov't Code Ann. § 22.221; see also Tex. R. App. P. 52. In the petition, relators ask this Court to compel the Honorable Michael Gomez, presiding judge of the 129th District Court of Harris County, to vacate his January 11, 2024 order denying relators' motion for protection and motion to quash and granting the real-party-in-interest's motion to compel the deposition of David Cordish.
Also on January 30, 2024, relators filed an emergency motion to stay the trial court's January 11, 2024 order. We grant the motion. Accordingly, we order the trial court's January 11, 2024 order compelling the deposition of David Cordish stayed until this court's disposition of relator's petition for writ of mandamus.
DISSENTING ORDER
Jerry Zimmerer, Justice
The record indicates that Mr. Cordish was designated as a person with knowledge of relevant facts by multiple parties. Moreover, the record indicates he had not only personal first-hand knowledge, but was an influencer, if not the actual decision maker in the acts prior to and leading up to the events made the basis of the plaintiffs' case. I would deny the emergency motion to stay.
