IN RE TEXAS ONCOLOGY PA, Relator

Original Proceedings from the 116th Judicial District Court Dallas County, Texas Trial Court Cause No. DC-20-02790

Before Justices Reichek, Goldstein, and Kennedy

ORDER

AMANDA L. REICHEK, JUSTICE

Before the Court is relator's January 30, 2024 petition for writ of mandamus and motion for emergency stay. It has come to the Court's attention that the parties have settled and that relator has nonsuited its claims against real parties in interest with prejudice in the trial court. However, relator has not filed a motion to abate or motion to dismiss in this original proceeding.

We ORDER relator to file on or before Friday, March 22, 2024, a motion to dismiss, a motion to abate, or a status report explaining why this original proceeding is not moot. We caution relator that the failure to file a motion to dismiss, motion to abate, or a status report as required by this Order will result in dismissal of this original proceeding without further notice.
