ON PETITION FOR WRIT OF MANDAMUS

Before Justices Benavides, Longoria, and Silva.

ORDER

PER CURIAM.

By petition for writ of mandamus, relator Texas Department of Public Safety contends that the trial court has abused its "discretion by preventing clearly discoverable information" and it lacks an adequate remedy by appeal to address this error.

We note that the cover of relator's petition for writ of mandamus indicates that relator is requesting emergency relief; however, the petition itself contains no specific request and relator has not filed a separate motion for temporary relief. See Tex. R. App. P. 52.10. Accordingly, any request for temporary relief is not properly before the Court at this time.

The Court requests the real party in interest, Cynthia Ann Gonzalez, or any others whose interest may be affected by the relief sought, to file a response to the petition for writ of mandamus on or before the expiration of five (5) days from the date of this order. See Tex. R. App. P. 52.2, 52.4, 52.8.
