On Appeal from the 59th Judicial District Court Grayson County, Texas Trial Court Cause No. FA-23-1386
ORDER
ROBERT D. BURNS, III CHIEF JUSTICE
The clerk's and reporter's records in this appeal have not been filed because appellant has not paid for them. By motion filed November 19, 2024, appellant requests that we (1) suspend the rules of appellate procedure and allow him to proceed without filing a brief, (2) set aside the appealed divorce decree, (3) disqualify opposing counsel, and (4) allow him to proceed without payment of costs. We GRANT the motion TO THE EXTENT appellant may proceed without payment of costs in this Court. See TEX. R. APP. P. 20.1(a). Fees charged for preparation of the clerk's and reporter's records are governed by Texas Rule of Civil Procedure 145. See id.; TEX. R. CIV. P. 145.
On the Court's own motion, we SUSPEND the deadline for the filing of the records to allow appellant an opportunity to file, in the trial court, a statement of inability to afford costs in accordance with Texas Rule of Civil Procedure 145. We ORDER appellant to file, no later than December 5, 2024, written verification that he has either filed a statement of inability to afford costs or paid for the records.
We DIRECT the Clerk of the Court to send a copy of this order to Grayson County District Clerk Kelly Ashmore, Official Court Reporter Gale Fiasco, and the parties.
