Order to show cause issued, returnable in Superior Court
The Secretary of the Department of Corrections and Rehabilitation is ordered to show cause before the Los Angeles County Superior Court, when the matter is placed on calendar, why petitioner is not entitled to a resentencing hearing. (See In re Kirchner (2017) 2 Cal.5th 1040; People v. Gutierrez (2014) 58 Cal.4th 1354.) The return is to be filed on or before July 28, 2017.
