IN RE TARGET CORPORATION, Relator

ORIGINAL PROCEEDING WRIT OF MANDAMUS 240th District Court Fort Bend County, Texas Trial Court Cause No. 23-DCV-306488

Panel consists of Justices Wise, Spain, and Hassan.

ABATEMENT ORDER

PER CURIAM.

On Wednesday, March 13, 2024, relator Target Corporation filed a petition for writ of mandamus in this court. See Tex. Gov't Code Ann. § 22.221; see also Tex. R. App. P. 52. On May 13, 2024, relator and real party in interest, Jesus Cantu-Trevino, filed a joint motion to abate this appeal while "the parties work to settle all claims in the underlying action." We grant the motion.

Relator's amended petition for writ of mandamus fails to comply with Texas Rule of Appellate Procedure Rule 52.7(a)(1) because it does not include "a certified or sworn copy of every document that is material to the relator's claim for relief and that was filed in any underlying proceeding." Tex.R.App.P. 52.7(a)(1).

The appeal is abated, treated as a closed case, and removed from this court's active docket until July 15, 2024. The appeal will be reinstated on this court's active docket at that time, or when a motion to reinstate is filed.
