ORDER

RICHARD HIGHTOWER, JUDGE

Relators Southwestern Motor Transport, Inc. and Jeremy Tremaine Parson filed a petition for writ of mandamus challenging the trial court's oral ruling on Thursday, November 14, 2024 that (1) evidence of the relator employee-driver's ordinary and gross negligence would be admissible in the first phase of the bifurcated trial, and (2) the trial court would permit argument and submission of jury questions about gross negligence of the employee-driver in phase one of the bifurcated trial. Relators filed an emergency motion to stay trial set to begin on Monday, November 18, 2024. Relators do not ask for a stay of proceedings other than trial.

The Court grants the emergency motion and orders trial, which is set to begin on Monday, November 18, 2024, stayed pending disposition of this petition for writ of mandamus. Proceedings other than trial are not stayed at this time.

The Court directs real parties in interest to file responses to the petition within 20 days of the date of this order.

It is so ORDERED.
