Opinion Issued September 15, 2004.
Original Proceeding from the 255th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 04-08571.
Writ of Mandamus Denied.
Before Justices MORRIS, RICHTER, and MAZZANT.
MEMORANDUM OPINION
Relator contends the trial judge erred in denying its motion to abate. Relator does not include a copy of an order denying its motion to abate in its record. Relator submits a docket sheet entry as proof of the trial court's ruling. Docket sheet entries are not a substitute for a written order. In re Beck, 26 S.W.3d 553, 555 (Tex. App.-Dallas 2000, orig. proceeding); Bailey-Mason v. Mason, 122 S.W.3d 894, 897 (Tex. App.-Dallas 2003, pet.denied). We deny the petition for failure to present a proper record. Additionally, on the merits, we conclude relator has failed to show the trial court clearly abused its discretion in denying the motion to abate. Accordingly, relator's motion emergency stay and petition for writ of mandamus are DENIED. See Tex.R.App.P. 52.8(a).
