Case No. 1:01-CV-9000, (MDL Docket No. 1401) (N.D. Ohio Mar. 20, 2002)

Opinion

Case No. 1:01-CV-9000, (MDL Docket No. 1401).

March 20, 2002.

MEMORANDUM AND ORDER

Earlier, Class Counsel for the Plaintiffs, together with SubClass Counsel, submitted to the Court proposed, draft versions of the Final Notice of Settlement, Class Member and Attorney Guide to the Settlement, and Benefit Claim Forms. The Court spent substantial time reviewing these documents, and suggested various amendments. Plaintiffs now submit final versions of the documents and move for formal approval (docket no. 243).

Having reviewed these documents once again, the Court finds they accurately describe the terms of the Settlement Agreement. Furthermore, the Court finds these documents satisfy all of the requirements of Fed.R.Civ.P. 23(c)(2) and 23(e), as well as due process requirements. Accordingly, the motion to approve the form of the proposed Final Notice of Settlement, Class Member and Attorney Guide to the Settlement, and Benefit Claim Forms, is GRANTED.

IT IS SO ORDERED.
