ON PETITION FOR A WRIT OF MANDAMUS AND PROHIBITION IN CAUSE NO. 22-04628-3 IN THE COUNTY COURT AT LAW #3 FROM WILLIAMSON COUNTY

ORDER

Per curiam

Relator filed a motion for leave to file and a petition for a writ of prohibition and writ of mandamus, invoking our constitutional and statutory authority to issue writs of mandamus and prohibition in criminal law matters. TEX. CONST. art. V, § 5; TEX. CODE. CRIM. PROC. art. 4.04. The petition requests that we issue a writ of prohibition in the underlying case, preventing the judge from issuing a warrant against the real party in interest for failing to appear in his court on March 30, 2023, if in fact, the real party in interest did not appear. The petition also requests that we issue a writ of mandamus for the judge to issue an arrest warrant against the real party in interest for possession of marijuana as provided in the information filed against her.

The respondent, Hon. Doug Arnold, the Judge of the County Court at Law #3 of Williamson County, is ordered to file a response with this Court. The motions for leave to file petitions for a writ of mandamus and prohibition will be held in abeyance until the respondent has submitted the appropriate response. Such response shall be submitted within 30 days of the date of this order. The underlying criminal case, cause number 22-04628-3 is stayed pending further order of this Court.
