ORDER


Respondent, HEATH H. McWHORTER, was suspended for thirty days, effective May 29, 2008, by judgment of this Court filed on April 29, 2008. Respondent filed an affidavit on June 30, 2008, in lieu of application for reinstatement, pursuant to Rule 64(e)(2)(A), Rules of the Supreme Court of Arizona. The State Bar filed a response to the affidavit alleging that respondent had engaged in the practice of law during his period of suspension in violation of Rule 72(d). Respondent filed a reply challenging the State Bar's allegations. Upon review, the Court concludes that respondent may be reinstated. Accordingly,

IT IS ORDERED that HEATH H. McWHORTER be and hereby is reinstated as a member of the State Bar of Arizona, effective the date of this order.
