In the Matter of Marc A. Spielberg, An Attorney At Law (Attorney No. 013801976)


ORDER

The Disciplinary Review Board having filed with the Court its decision in DRB 21-089, concluding on the record certified to the Board pursuant to Rule 1:20-4(f)(default by respondent) that Marc A. Spielberg, formerly of Barnegat Light, who was admitted to the bar of this State in 1976, and who has been temporarily suspended from the practice of law since September 10, 2020, should be reprimanded for violating RPC 1.4(b) (failure to communicate with client), RPC 1.15 (b) (failure to promptly deliver to client or third person any funds the client or third person is entitled to receive), RPC 1.15 (d) (failure to comply with attorney recordkeeping requirements), and RPC 8.1(b) (failure to cooperate with disciplinary authorities);

And the Disciplinary Review Board having further determined that respondent should be required to take certain actions in respect of funds in his attorney accounts and in respect of his status to practice law;

And the Court by Order filed September 10, 2020, having ordered that the funds in respondent's attorney accounts be restrained from disbursement and held in the Superior Court Trust Fund pending the further Order of the Court, and said funds having been so transferred by the Office of Attorney Ethics on October 2, 2020;

And good cause appearing;

It is ORDERED that Marc A. Spielberg is hereby reprimanded; and it is further

ORDERED that Marc A. Spielberg remain suspended from the practice of law pursuant to the Order of the Court filed September 10, 2020, until the further Order of the Court; and it is further

ORDERED that respondent continued to comply with Rule 1:20-20 dealing with suspended attorneys; and it is further

ORDERED that the entire record of this matter be made a permanent part of respondent's file as an attorney at law of this State; and it is further

ORDERED that respondent reimburse the Disciplinary Oversight Committee for appropriate administrative costs and actual expenses incurred in the prosecution of this matter, as provided in Rule 1:20-17.
