Administrative Order No. 2008-94, Repealing and Replacing Administrative Order 2008-31
November 26, 2008.
In order to implement the Access to Recovery (ATR) Grant, Administrative Order No. 2008-31 was entered on April 3, 2008, providing Pima Prevention Partnership (PPP) with special access to records and information concerning drug court participants. At the time the order was entered, the Administrative Office of the Courts (AOC) was a subgrantee under the ATR Grant. The AOC will cease participation in the ATR Grant as of November 30, 2008, and will no longer be a subgrantee. The Governor's Office for Children, Youth and Families (GOCYF) may enter into subgrantee agreements directly with the participating superior courts, on behalf of their drug courts. In order to meet the requirements of the ATR grant and allow the continued access by PPP to records and information concerning drug court participants, it is necessary to enter this order to remove the Administrative Officer of the Courts from participation in the ATR Grant and to allow access to relevant records to continue.
Now, therefore, pursuant to the Supreme Court's administrative supervisory authority (Arizona Constitution, Article 6 § 3) and rule-making authority (Arizona Constitution, Art. 6 § 5) over all of the courts of the state,
IT IS ORDERED that PPP continues to have authorization to receive the information concerning probationers that is required to comply with the ATR Grant. Participating superior courts, on behalf of their drug courts, shall enter into an information sharing agreement directly with PPP as soon as possible. In the interim, information shall be shared consistent with the terms of the information sharing agreement between the AOC and PPP. Access to information under this order shall continue until local drug court information sharing agreements are signed and thereafter.
IT IS FURTHER ORDERED that PPP may share the information it receives pursuant to this order, with the vendor of the Voucher Management System and the Office of the Arizona Governor as necessary or required by the ATR Grant.
IT IS FURTHER ORDERED that Administrative Order No. 2008-31 is repealed and replaced by this Administrative Order.
