RE: Spartanburg County Truancy Program for the Seventh Judicial Circuit


ADMINISTRATIVE ORDER

DONALD W. BEATTY CHIEF JUSTICE OF SOUTH CAROLINA

I FIND that the increasing number of habitual truant cases have contributed to congesting the court dockets in the Family Courts in Spartanburg County.

I FURTHER FIND that these cases could be efficiently and effectively addressed through a diversion program, which would benefit juveniles and their parent(s) or guardian(s).

NOW, THEREFORE, pursuant to Article V, Section 4 of the South Carolina Constitution, IT IS ORDERED that the Spartanburg County Truancy Program for the Seventh Judicial Circuit (the Program) shall be established. The Program is a diversion program that will address habitual truants who may be referred for judicial intervention under section 43-274 of the South Carolina Code of Regulations. Further, the Program will address parents or guardians, who are responsible for ensuring their child regularly attend an approved public or private school or kindergarten of this state. S.C. Code Ann. § 59-65-10(A). The requirements for the Program, which will be posted on the website for the Seventh Judicial Solicitor's Office and the Spartanburg County School Districts, will comply with S.C. Code Ann. §§ 17-22-10 to -170.

This Order takes effect immediately and remains in effect unless amended or rescinded by the Chief Justice.
