IN THE MATTER OF BRIAN J. SMITH AN ATTORNEY AT LAW (ATTORNEY NO. 017501993)
ORDER
The Disciplinary Review Board having filed with the Court its decisions in DRB 23-231, recommending on the record certified to the Board pursuant to Rule l:20-4(f) (default by respondent) that Brian J. Smith, formerly of Huntingdon Valley, Pennsylvania, who was admitted to the bar of this State in 1994, and who has been suspended since March 7, 2022, should be suspended for six months for violating RPC 8.1(b) (failing to cooperate with disciplinary authorities) (two instances) and RPC 8.4(d) (engaging in conduct prejudicial to the administration of justice);
And the Court having determined from its review of the matter that a censure is the appropriate quantum of discipline for respondent’s unethical conduct;
And good cause appearing;
It is ORDERED that Brian J. Smith is hereby censured; and it is further
ORDERED that respondent shall remain suspended from the practice of law pursuant to the orders filed on February 11, 2022 and September 23, 2022; and it is further
ORDERED that the entire record of this matter be made a permanent part of respondent’s file as an attorney at law of this State; and it is further
ORDERED that respondent reimburse the Disciplinary Oversight Committee for appropriate administrative costs and actual expenses incurred in the prosecution of this matter, as provided in Rule 1:20-17.
