MEMORANDUM OPINION
Relator Howard Shulman filed a petition for a writ of mandamus in this court on May 1, 2020. See Tex. R. App. P. 52.1. Relator requests this court to order the presiding judge of the 234th District Court of Harris County, the Hon. Lauren Reeder, to vacate her January 13, 2020 order abating the underlying case (the "Order"). The Order abates the underlying case "until August 15, 2021, or until the IRS assesses Plaintiff the tax liability at issue in the lawsuit, whichever is sooner."
This is the second petition for mandamus Shulman has filed regarding an abatement order in the underlying case. In the first proceeding, we conditionally granted the petition. See In re Shulman, 544 S.W.3d 861 (Tex. App.—Houston [14th Dist.] 2017, orig. proceeding) ("Shulman I"). We detailed the factual background of this case in Shulman I, and we need not repeat it here.
The current circumstances of the underlying case differ materially from those presented when we decided Shulman I in 2017. Upon review of the challenged order and the record, we conclude that Shulman has not established he is entitled to mandamus relief from the Order. We deny the petition for writ of mandamus.
