Jeffrey E. Raskin and Stefan Love of Greines, Martin, Stein and Richland LLP are appointed to brief and argue this case, on a pro bono basis, in support of the Court of Appeal's holdings that (1) in the trial court, S.H.R. was required to establish his eligibility for Special Immigrant Juvenile findings by a preponderance of the evidence (Guardianship of S.H.R.(2021) 68 Cal.App.5th 563, 574-576); (2) the trial court's denial of a petition for Special Immigrant Juvenile findings should be affirmed on appeal unless the evidence before the trial court compels a finding in favor of the juvenile as a matter of law (ibid.); and (3) the trial court did not commit reversible error in denying S.H.R.'s petition for Special Immigrant Juvenile findings (id. at pp. 577-582). Before this court, counsel shall represent these positions, and not any party.
For purposes of California Rules of Court, rule 8.520, appointed pro bono counsel will be treated as the opposing party and the brief will be treated as the answer brief.
The court intends to hold oral argument in this case on an expedited basis. To allow sufficient time to consider all briefing in advance of argument, we establish the following schedule:
1.) S.H.R. shall serve and file the opening brief on the merits on or before January 28, 2022;
2.) Appointed pro bono counsel shall serve and file the answer brief on or before March 7, 2022;
3.) S.H.R. may serve and file a reply brief on or before March 14, 2022;
4.) Applications for permission to file an amicus curiae brief may be served and filed on or before March 21, 2022;
5.) Any answer to an amicus curiae brief shall be served and filed on or before March 28, 2022.
Extensions of time are not contemplated and will be granted based only on a showing of extraordinary circumstances.
