ORDER ON MOTION FOR EN BANC RECONSIDERATION

This Court's opinion and judgment issued on November 28, 2023. Thus, any motions for rehearing or en banc reconsideration were due on December 13, 2023. See Tex. R. App. P. 49.1, 49.5. On December 13, 2023, appellant filed a motion for rehearing. We denied the motion for rehearing on April 9, 2024. On April 19, 2024, appellant filed a motion for en banc reconsideration and a further motion for rehearing. Because the motion for en banc reconsideration was not filed with the 15-day deadline of this Court's judgment, this motion is untimely. See Tex. R. App. P. 49.1, 49.5.

Accordingly, appellant's motion for en banc consideration is untimely and dismissed as moot. See Tex. R. App. P. 49.1, 49.5.

[*] En banc Court consists of: Chief Justice Adams and Justices Kelly, Goodman, Landau, Hightower, Countiss, Rivas-Molloy, and Guerra. The Honorable April L. Farris, former Justice of this Court, was a member of the Court when the case was submitted but did not participate in the decision of the case. Her term of office expired on August 31, 2024, and she did not participate in the decision on this motion. See Tex. R. App. P. 49.3.
