ORDER
The plaintiff, Colgan Law Firm LLC, appears by counsel James P. Colgan of Kansas City, Kansas. The defendant, Mr. David Allen Servos, appears pro se. The Court finds that this proceeding is core under 28 U.S.C. § 157 and the Court has jurisdiction under 28 U.S.C. §§ 1334 and 157.
On January 27, 2005, the plaintiff's Complaint to determine dischargeability came on for hearing before the Court. At the hearing, after due consideration of the testimony presented at trial, the arguments of counsel, and the record, the Court found that the plaintiff did not satisfy its burden in proving it was entitled to judgment on its Complaint. Accordingly, the defendant is entitled to discharge his debt to the plaintiff.
The findings of fact and conclusions of law recorded in open court constitute the complete grounds for the Court's action, as required by Fed.R.Bankr.P. 7052 and Fed.R.Civ.P. 52, rather than any paraphrased findings set out in this Order. The Court reserves the right to issue further findings and conclusions.
