AGREED ORDER REGARDING CLAIM NO. 5250 FILED BY 600 ENTERPRISES
Upon the agreement of Service Merchandise Company, Inc. and 31 of its affiliates (collectively, the "Reorganized Debtors"), and 600 Enterprises (the "Claimant"); and the Reorganized Debtors and the Claimant having agreed, as signified by the signatures of counsel below, to the treatment of Claim No. 5250 (the "Claim") filed by the Claimant on the terms set forth in this Agreed Order; and the Court being otherwise sufficiently advised, it is hereby
ORDERED, ADJUDGED AND DECREED:
1. The Claim shall be and hereby is ALLOWED as a general prepetition non-priority unsecured claim in the amount of $252,000.00 against Service Merchandise Company, Inc. in Case No. 399-02649.
2. The Claimant shall be and hereby is granted a Chapter 11 administrative expense claim against Service Merchandise Company, Inc. in Case No. 399-02649 in the amount of $10,000.00, which shall have priority under 11 U.S.C. § 503(b) and 507(a)(1) and which shall be paid promptly after entry of this order.
3. The Court shall retain jurisdiction to hear any matters or disputes arising from or relating to this order.
