IN RE RYAN SEALES, Relator

Do not publish. Tex.R.App.P. 47.2(b).

Original Proceeding on Petition for Writ of Mandamus

Panel consists of Justices Kelly, Countiss, and Rivas-Molloy.

MEMORANDUM OPINION

PER CURIAM.

Relator, Ryan Seales, filed a petition for writ of mandamus, challenging the trial court's order denying his motion to dismiss his indictment for the offense of continuous sexual abuse of a child in the underlying case. See Tex. Penal Code Ann. § 21.02. Relator argues that the trial court abused its discretion in denying the motion because "the facts clearly show substantial government interference with a material defense witness," the trial court "had a ministerial duty to dismiss the indictment," and relator "has no adequate remedy at law given that the fundamental fairness of his trial was and remains compromised."

The underlying case is The State of Texas v. Ryan Seales, Cause No. 1561941, pending in the 228th District Court of Harris County, Texas, the Honorable Frank Aguilar presiding.

We deny relator's petition for writ of mandamus. Tex.R.App.P. 52.8(a). All pending motions are dismissed as moot.
