ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING

MOORE, J.

It is ordered that the opinion filed herein on January 2, 2008, be modified as follows:

1. On page 10, the first full paragraph, delete the following sentence: “A few months prior to the section 388 hearing, the grandparents expressed a desire to have S.D. ‘returned to his mother, but if he is not, they are committed to adopting him,’ an ambivalent commitment at best.”

2. On page 10, insert the following sentence in place of the deleted language: “The grandparents expressed a desire to have S.D. ‘returned to his mother, but if he is not, they are committed to adopting him,’ an ambivalent commitment at best.”

This modification does not effect a change in the judgment. The petition for rehearing is DENIED.
