ORDER

KEN MOLBERG, JUSTICE

In accordance with the Court's opinion issued this date, we conditionally GRANT relator Nicholas Schrandt's petition for writ of mandamus. The Court ORDERS respondent, the Honorable Martin Hoffman, Judge of the 68th Judicial District Court, to VACATE the portions of the associate judge's July 11, 2024 order and respondent's August 15, 2024 order dismissing with prejudice the breach of contract claim asserted in count eleven of Schrandt's first amended petition and to FILE with this Court, within fourteen days of the date of this order, a copy of the order issued by the trial court in compliance with this order. Should respondent fail to comply with this order, the writ will issue. The Court also ORDERS that relator Nicholas Schrandt recover his costs of this original proceeding from real party in interest E3 Energy Solution Co.
