In the Matter of Alexei M. SCHACHT, admitted as Alexei Marc Schacht, a suspended attorney.


Motion by Alexei M. Schacht for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Schacht was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the First Judicial Department on January 22, 1990, under the name Alexei Marc Schacht. By decision and order on application of this Court dated February 29, 2008, the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts was authorized to institute and prosecute a disciplinary proceeding against Mr. Schacht and the issues raised were referred to the Honorable Vincent Pizzuto, as Special Referee to hear and report. By decision and order on motion dated July 2, 2008, this Court denied Mr. Schacht's motion, inter alia, pursuant to 22 NYCRR 691.4(m) to stay the hearing before the Special Referee and direct Mr. Schacht to complete a monitoring program sponsored by a lawyer's assistance program approved by the Court, or to approve the formal monitoring program sponsored by the New York City Lawyer Assistance Program as a qualifying monitoring program. By decision and order on motion of this Court dated February 9, 2010, the Honorable Vincent Pizzuto was relieved as Special Referee and the matter was reassigned to John P. Clarke, as Special Referee to hear and report. By opinion and order dated December 17, 2010, this Court suspended Mr. Schacht from the practice of law for a period of one year, commencing January 27, 2011, based on five charges of professional misconduct ( see Matter of Schacht, 80 A.D.3d 157, 914 N.Y.S.2d 206). By decision and order on motion of this Court dated February 8, 2012, Mr. Schacht's motion for reinstatement was held in abeyance and the matter was referred to the Committee on Character and Fitness to investigate and report on his fitness to practice law.

Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the report of the Committee on Character and Fitness and the exhibits annexed thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that, effective immediately, Alexei Marc Schacht is reinstated as an attorney and counselor-at-law, and the Clerk of the Court is directed to restore *888the name of Alexei Marc Schacht to the roll of attorneys and counselors-at-law.
