ORDER DENYING OBJECTION TO CLAIM WITHOUT PREJUDICE


The matter before the court is the objection filed by the chapter 13 debtors, Robert M. Sawyer and Cynthia L. Sawyer, to the proof of claim filed by the Internal Revenue Service. A hearing was held in Raleigh, North Carolina on January 5, 1999.

The chapter 13 debtors objected to the proof of claim filed by the Internal Revenue Service, and the Internal Revenue Service contends that the objection should be brought in the form of an adversary proceeding. The debtors agree, and the objection is DENIED WITHOUT PREJUDICE to the debtors' right to file an adversary proceeding within 15 days from the date of this order.
