Opinion

No. 05-05-00386-CV

Opinion Issued March 30, 2005.

Original Proceeding from the 330th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 03-14637-Y.

Writ of Mandamus Denied.

Before Justices WRIGHT, O'NEILL, and LANG.

MEMORANDUM OPINION

Relator contends the trial judge erred in denying relator's motion to dismiss, failing to remove affidavits from the record, and failing to remove the attorney/guardian ad litem's pleadings. Based on the record presented, we conclude relator has failed to show the trial court abused its discretion in denying relator's motion to dismiss, failing to remove affidavits from the record, and failing to remove the attorney/guardian ad litem's pleadings. Accordingly, we DENY relator's petition for writ of mandamus. See Tex.R.App.P. 52.8(a).
