IN RE Andy SANCHEZ

MEMORANDUM OPINION

Original Proceeding PER CURIAM Sitting: Karen Angelini, Justice Marialyn Barnard, Justice Luz Elena D. Chapa, Justice PETITION FOR WRIT OF HABEAS CORPUS DISMISSED FOR LACK OF JURISDICTION

This proceeding arises out of Cause No. 2011-CR-6969, styled State of Texas v. Andy Sanchez, pending in the 436th District Court, Bexar County, Texas, the Honorable Lisa Jarrett presiding.

On September 25, 2017, petitioner Andy Sanchez filed a pro se petition for writ of habeas corpus with this court, complaining of his incarceration in the Texas Department of Criminal Justice. This court has no original habeas corpus jurisdiction in criminal matters. Dodson v. State, 988 S.W.2d 833, 835 (Tex. App.—San Antonio 1999, no pet.). In criminal matters, the courts authorized to issue writs of habeas corpus are the Texas Court of Criminal Appeals, district courts, and county courts. TEX. CODE CRIM. PROC. ANN. art. 11.05 (West 2015). Therefore, the petition for writ of habeas corpus is dismissed for lack of jurisdiction.
