IN RE SAM MOON GROUP, SAM MOON, COYOTE RIDGE GOLF CLUB, AND DAVID MOON, Relators
Original Proceeding from the 192nd Judicial District Court Dallas County, Texas
Trial Court Cause No. DC-19-04354
MEMORANDUM OPINION
Before Justices Schenck, Partida-Kipness, and Nowell
Opinion by Justice Partida-Kipness
Before the Court are relators' May 15, 2020 petition for writ of mandamus and emergency motion to stay discovery. In their petition, relators complain of the trial court's order denying relators' motions for protection from discovery requests and granting real parties in interest's motions for extension and continuance.
To be entitled to the extraordinary relief of a writ of mandamus, relators must show that they have no adequate remedy by appeal and that the trial court clearly abused its discretion. In re Prudential Ins. Co., 148 S.W.3d 124, 135-36 (Tex. 2004) (orig. proceeding). Based on the record before us, we conclude relators have not established their right to mandamus relief. Accordingly, we deny relators' petition for writ of mandamus. See TEX. R. APP. P. 52.8(a) (the court must deny the petition if the court determines relator is not entitled to the relief sought). Further, having denied mandamus relief, we deny relators' emergency motion as moot.
